The legality of Salvia divinorum and salvinorin A (the active hallucinogenic compound in salvia leaves are not currently controlled under the federal controlled substances act. Salvia divinorum is officially authorized to use, grow and posses in most of the United States and the same is right for most other countries.
But individual states in the USA and other countries have positioned controls on Salvia divinorum and or salvinorin A. As of November 2008, thirteen states have enacted legislation placing dictatorial controls on Salvia divinorum and or salvinorin A. Delaware, Florida, Illinois, Kansas, Mississippi, Missouri, North Dakota, Oklahoma, and Virginia have positioned Salvia divinorum and or salvinorin A into schedule I of disorder law.
California, Louisiana, Maine and Tennessee enacted other forms of legislation restricting the distribution of the plant.
States in which legislative bills proposing dictatorial controls died are Alabama, Alaska, Hawaii, Indiana, Iowa, Minnesota, Nebraska, Oregon, South Carolina, and Utah.
Legislative bills proposing dictatorial controls are pending in Michigan, New Jersey, New York, Pennsylvania, Texas and Wisconsin.
Salvia Divinorum is illegal in: Delaware, Florida, Illinois, Kansas, Louisiana, Mississippi, Missouri, North Dakota, Nebraska, Ohio, Oklahoma and Virginia.
Salvinorin A and or Salvia divinorum have been positioned under dictatorial controls in Australia, Belgium, Denmark, Estonia, Finland, Italy, Japan, Spain, and Sweden.
